Terms of Service

These terms govern use of DreamSoft, operated by DreamLearn Quiz LLP, and cover both products it runs under one account: CallMitra (AI voice agents, RCS and SMS) and the WhatsApp Business API inbox. By creating an account or using either service, a customer agrees to them.

1. The service

CallMitra lets a customer build AI agents that make and receive phone calls, launch outbound calling campaigns, and send follow-up messages over WhatsApp, RCS, and SMS. The customer configures what their agents say and do; CallMitra provides the platform that runs it.

2. Accounts

A customer is responsible for the accuracy of the information they provide, for keeping their login credentials secure, and for all activity that happens under their account.

3. Acceptable use

A customer may not use CallMitra to:

• Call or message anyone who hasn't consented to being contacted, or in violation of applicable telecom/DND regulations (e.g. TRAI rules in India).
• Send promotional SMS/calls outside legally permitted hours, or without the required DLT/template registrations where applicable.
• Impersonate a person or organization, or misrepresent who is calling.
• Use the platform for fraud, harassment, or any illegal purpose, including unlawful gambling, financial scams, or deceptive practices.
• Attempt to interfere with or gain unauthorized access to the platform or another customer's account/data.

A customer is solely responsible for the content their agents say and send, and for having the right to contact the numbers they call or message.

4. Billing

CallMitra is billed on a prepaid wallet — a customer adds funds, and call minutes and messages sent are deducted as they're used, at the rate shown in their dashboard. Unused balance remains available in the wallet; specific refund or rate questions are handled by contacting us directly.

5. WhatsApp Business API

Connecting a WhatsApp number adds obligations that come from Meta rather than from us, so they are set out separately:

• The account is the customer's. The WhatsApp Business Account and phone number are registered under the customer's own Meta Business account. We operate the inbox on top of it under the access the customer grants, and that access can be withdrawn at any time.
• Meta's policies apply directly. A customer must comply with Meta's WhatsApp Business Messaging Policy and Commerce Policy in addition to these terms. Those policies prohibit certain categories outright, and Meta enforces them against the customer's number, not against us.
• Opt-in is required. A customer may only message people who have agreed to be contacted on WhatsApp, and must honour opt-out requests promptly.
• Templates are approved by Meta. Messages sent outside WhatsApp's 24-hour customer service window must use a template Meta has approved. Meta may reject, pause or disable a template at any time, and we cannot overturn that decision.
• Meta bills the customer separately. WhatsApp conversation charges are billed by Meta to the payment method on the customer's own WhatsApp Business Account. That is separate from anything payable to us, and messages will not send if that account has no valid payment method.
• Quality and limits are Meta's call. Meta assigns each number a quality rating and a messaging limit, and may restrict or disable a number that generates blocks or complaints. We will tell a customer what we can see, but we do not control the outcome.

A customer remains responsible for the content of every message sent from their number and for holding the right to contact each recipient.

6. Third-party providers

Calls and messages are carried through third-party telephony, AI, and messaging providers (see our Privacy Policy for the full list). CallMitra is not responsible for outages or failures originating from those providers, though we work to route around them where possible.

7. Suspension

We may suspend an account that violates these terms, abuses the platform, or where required by law — where practical, we'll try to notify the customer first.

8. Disclaimer & liability

CallMitra is provided "as is." We don't guarantee uninterrupted service, since calling and messaging depend on third-party networks outside our control. To the extent permitted by law, our liability for any claim is limited to the amount the customer paid us in the three months before the claim arose.

9. Governing law

These terms are governed by the laws of India, and the courts at Jaipur, Rajasthan have jurisdiction over any dispute arising from them.

10. Changes

We may update these terms as the service evolves. Continued use after a change means the customer accepts the update; the "Last updated" date above will always reflect the latest version.
